VOLUME 27, NO. 20 TUESDAY, JANUARY 31, 2012 **************************************************** Autopsy Results: Preliminary autopsy results in the death of Thomas Gleason James Jr. indicate the 28-year-old Liberty man died of an accidental drowning. T.J. James was found Friday afternoon in the swimming pool at his family’s home in the Forest Hills Subdivision. **************************************************** Harrelson Suit Dismissed: It was 2002 when newly elected County Treasurer Janet Harrelson was removed from that position. She was later convicted on four charges relating to criminal conduct. In January 2011, she filed a lawsuit against Liberty County over her removal from office. The petition was filed in the 75th district court, seeking unspecified damages. In November last year, District Judge Mark Morefield ruled time limitations to file such a suit had run out, dismissing Ms. Harrelson’s lawsuit. **************************************************** Dayton ISD Wall of Fame: Tomorrow is the deadline for nominating a former professional employee of the Dayton Independent School District for the “Wall of Fame”. Preliminary autopsy results are expected today. **************************************************** Woman Found Dead: An autopsy has been ordered in the death of Lori Lynn Garner, 47, who was found dead Friday night in the back room of a Louisiana Street home. Pct. 1 Bobby Rader said the woman’s death appears to be from natural causes. **************************************************** Primary Election: A three-judge panel in San Antonio has canceled the February 1 filing deadline and the February 3 ballot position draw for the upcoming Democrat and Republican primary elections. New dates have not been set for either of those election functions. **************************************************** Cleveland Manager: The City of Cleveland has hired a new city manager. Dion Miller will take the reigns as Cleveland’s top administrator on February 21. Previously, Mr. Miller served as city manager in the Texas cities of Commerce and Mineola **************************************************** Appraisal District: The Liberty County Central Appraisal District has received the top rating on the Texas Comptroller’s bi-annual Methods and Assistance Program Audit. That state audit evaluates every appraisal district across Texas. Liberty County Chief Appraiser Alan D. VOLUME 27, NO. 18 FRIDAY, JANUARY 27, 2012 **************************************************** Liberty City Council: The Liberty City Council met in special session Tuesday to discuss financial issues. Council members heard from Auditor Lee Ann Brents from C.P.A. firm Swaim, Brents and Associates on the city’s annual audit report for fiscal year 2010-2011. Mrs. Brents told council the report showed the city is in good financial health with plenty of indications that will continue into the next year. **************************************************** LISD Board Election: Liberty Independent School District Trustees have called an election from May 12 to elect three board members to three-year terms. Board members with terms expiring are Matt Harris, Bruce Bell and Frank Davis. Incumbents Matt Harris and Bruce Bell have both said they will seek reelection. On the other hand, Frank Davis says he will not seek another term. Liberty School Trustees are elected at-large, meaning the top three vote-getters will be elected. **************************************************** Chamber Business Expo: Spaces are still available for the Liberty-Dayton Area Chamber of Commerce 2012 Business Expo Thursday April 12. The annual event showcases the local business community and has continued to grow in popularity. The Hardin School board met on Monday night and following their annual evaluation on Superintendent Bob Parker renewed his contract for an additional two years, taking it through the 2015-2016 school year. VOLUME 27, NO. 17 THURSDAY, JANUARY 26, 2012 **************************************************** LISD: Boomerang Tube is expected to make its first “payment in lieu of taxes” to the Liberty Independent School District by this coming Tuesday. However, because of changes the legislature made to state funding, Boomerang’s financial obligation is about three times what school and Boomerang officials originally projected and agreed to. In response, LISD held a special board meeting Tuesday night to consider allowing Boomerang to spread out the $1.296 million, now owed, into payments over several years. Liberty ISD Trustees approved a first payment of slightly more than $400,000 by Tuesday, and then the remaining will be paid in four equal payments beginning July 1. Boomerang will also make their future payments by January 31 for the next six years at a projected amount of about $500,000 annually. **************************************************** Rain: While rain amounts vary from place to place, KSHN Radio recorded a full 3 inches of rainfall from Tuesday afternoon to Wednesday afternoon. That’s in the official U.S. Weather Service rain gauge here at KSHN Studios in downtown Liberty. The last time Liberty saw a rain of more than an inch was last month, and the last rain of more than 2” was in July last year. VOLUME 27, NO. 16 WEDNESDAY, JANUARY 25, 2012 **************************************************** Commissioners: Liberty County Commissioners Court received a $10,000 check yesterday from the Texas Forest Service to reimburse the county for some expenses associated with creation of a local community wildfire protection plan. Liberty County is one of only 15 of Texas’ 254 counties that have such a plan in place. Liberty County Emergency Management Coordinator Tom Branch said the purpose of the plan is to protect human life and reduce property loss due to wildfires. At the recommendation of Tom Branch, commissioners voted unanimously to use those dollars to purchase communications equipment for area firefighters. **************************************************** Unemployment Numbers: The unemployment rate for both Liberty and Chambers counties ticked higher during December. However, upon closer inspection of state data, the actual number of area residents with jobs also increased. The state data reports the number of people looking for jobs here locally also increased. So, while more Liberty and Chambers County residents are working then at any time during the past 12 months, the local unemployment rates ticked up slightly because more locals are entering or reentering the workforce. **************************************************** Health Fair: The Dayton Community Center will host a free health fair TOMORROW from 10 a.m. to 2 p.m. The health fair is sponsored by Memorial Hermann Northeast Hospital in Humble along with the Liberty Dayton Chamber of Commerce, the Dayton Chamber of Commerce, and the Dayton Community Center. For business owners, Liberty County Chief Appraiser Alan Conner said filing your rendition on personal property owned by the business is required by law and must be submitted by April 15 to avoid the county adding 10 % to your tax obligation. A rendition, according to Mr. Conner is the form filled out to reflect value of property used in your business such as furniture, fixtures, computers and other similar property. **************************************************** Truck Crash: A one vehicle crash on FM 1008 near Dayton sent one man to San Jacinto Hospital in Baytown. According to Liberty County Sheriff’s Captain Rex Evans, the driver, whose name was not available, left the roadway in his pick up truck and struck a tree. The truck caught fire, but passersby were able to remove the driver before flames reached the cab. Witnesses report the trucks driver was conscious and complaining of chest pain. The Texas Department of Public Safety is investigating the crash on FM 1008 just after 8 a.m. Monday morning. **************************************************** New Library Manager: After more than a year since Archivist Robert Schaadt retired, the Sam Houston Regional Library and Research Center will have a new manager. Alana Inman is a 1995 graduate of Newton High School here in Texas, although she has been out of state for some time. Alana Inman is expected to report for duty at the Sam Houston Regional Library on February 1st. **************************************************** New Support Group: A new support group is being formed for families of murdered children. The first meeting is this Friday at 5 p.m. in the Dayton Community Center. Organizer Candy Gore, who’s 15 year old daughter was rundown with a vehicle and killed in April 2011, said this new support group is for parents, siblings, aunts, uncles and grandparents who have experienced the murder of a child in their family. VOLUME 27, NO. 14 MONDAY, JANUARY 23, 2012 **************************************************** Election Confusion: Confusion continues to surround this year’s Democrat and Republican primary elections because of the ongoing court battle over redistricting. On Friday, the U.S. Supreme Court unanimously rejected Texas redistricting maps drawn earlier this year by a three-judge panel in San Antonio. Now, that judicial panel must redraw maps paying more attention to the maps adopted by the state legislature. Once approved, those maps also must go before a federal judicial panel in Washington to ensure they comply with the Voting Rights Act. So, what does that mean? While the primary has already been moved from early March to a new date of April 3 - that too could change because of the amount of time it will take to redraw the maps and gain final court approval. **************************************************** Juvenile Sentenced: One of six juveniles charged with sexual assault of a child in the Cleveland gang rape case was sentenced to seven years probation late Friday afternoon by Liberty County Court at Law Judge Tommy Chambers. Fourteen adults have also be charged in this case involving an 11-year-old girl. Five juveniles have entered pleas, and this is the fourth young defendant to be sentenced. Friday’s sentencing came after the juvenile recently entered what’s known as a plea of “true” to the charge of sexual assault of a child. One of the 14 adults has also pled guilty while the other 13 are awaiting trials. **************************************************** Murder Plea: A man identified as a Mexican national has pled guilty to murder in exchange for a five-year sentence in prison. Alberto Sanchez, 30, was accused in the shooting death of Juan Antonio Romero back on July 4, 2009. Liberty County District Attorney Mike Little said this was not the outcome his office had sought. He said too many witnesses either could not be located or could not be persuaded to testify in an American courtroom when they were in the country illegally. **************************************************** Proposed ESD: Tarkington Volunteer Fire Department has submitted a petition for a new Emergency Service District for the Tarkington area. County Clerk Paulette Williams must verify the validity of those signatures. If confirmed, the petition goes to commissioner’s court, which will draw the boundaries of the district and order an election. VOLUME 27, NO. 13 FRIDAY, JANUARY 20, 2012 **************************************************** Deducting a Hobby: Local CPA Byron Swaim said while certain businesses expenses are deductible from federal income taxes, costs associated with a hobby is not deductible. That is a change from last year. Byron Swaim said it’s the actions of the individual that indicates the intent. Are we doing something because we love it, or to produce a profit? That now determines if expenses are deductible. As with any tax question, they should be directed to the tax professional of your choice. **************************************************** Economic Planning: The public is invited to attend an economic planning meeting sponsored by the Houston Galveston Area Council of Governments Tuesday night. VOLUME 27, NO. 12 THURSDAY, JANUARY 19, 2012 **************************************************** City of Liberty: The Liberty City Council Monday night, directed legal action against the office of Texas Attorney General Greg Abbott. City Attorney Randy Gunter said a man by the name of Robert Valdez had filed an open records request with the city last year. City officials felt the information did not fall under the state’s open records law and requested an opinion on the request from the attorney general’s office. The state’s response, according to Randy Gunter, was not satisfactory, and Liberty City Council has now directed him to appeal the state attorney general’s ruling. **************************************************** Dayton Chamber: This month, the Dayton Chamber of Commerce will hold its 11th annual Chamber Banquet. To make reservations call the chamber office at 257-2393. **************************************************** LISD: Liberty Trustees approved a contract Tuesday with Architectural Alliance of Beaumont for design work and construction supervision for a new gymnasium at Liberty Elementary. In December, LISD Trustees approved a list of facilities projects for completion using recently board approved bond funs plus monies from the district’s fund balance. The board ok’ed both renovations and new construction totaling more than $3 million. VOLUME 27, NO. 11 WEDNESDAY, JANUARY 18, 2012 **************************************************** Guilty: Visiting Judge David Wilson found 31-year–old Gerald Nugent guilty of murder and sentenced him to 60 years in prison. The week long trial concluded Tuesday morning and visiting Judge Wilson returned a guilty verdict early yesterday afternoon. Nugent was accused of inflicting injuries on his infant daughter Brooke Glyn Nugent that resulted in her death some two years after her injuries. The child’s mother, Martina Sellers is also charged in her daughter’s murder but remains free on bond awaiting trial. **************************************************** Leggett Trial: Baytown woman Pamela Leggett is set to be tried in the Southern U.S. District Court in Houston on May 7th for allegedly accumulating chemicals that she and now deceased husband Gilbert Ortez used to make 122 homemade grenades. It was in July 2009 when investigators say Gilbert Ortez shot and killed Chambers County Sheriff’s Deputy Shane Detwiler. Chambers County DA Cheryl Leick said depending on the outcome of the federal trial, her office may still pursue prosecution of the state charges against Pamela Leggett. **************************************************** Taylor: The job of a Rotary District Governor entails the enormous responsibility of directing activities of numerous Rotary Clubs for a full year. At Tuesday’s Liberty Rotary Club meeting, former District Governor Rose Austin announced the longtime court judge and attorney has been named district Governor for Rotary District #5910 for years 2014-2015. **************************************************** Phishing: Local Certified Public Accountant Byron Swaim said the Internal Revenue Service is warning of an email scam. He said the emails appear to come from the IRS but tax payers should know, the Internal Revenue Service never contacts taxpayers in that manner. If you are the target of an IRS email scam, do not respond to the email, instead go the www.irs.gov and click on the “Phishing” link to report the email. VOLUME 27, NO. 10 TUESDAY, JANUARY 17, 2012 **************************************************** City Substation: The City of Liberty will soon be advertising for bids for installation of an entirely new electrical substation to double the power capacity for the City of Liberty. City Manager Gary Broz said they hope to have the new substation up and running by April. Mayor Carl Pickett said when Boomerang selected Liberty, they agreed to pay a facility charge that is currently some $83,000 per month to help offset the roughly $3.5 million it will cost to put in a new substation. The mayor said that should allow them to pay off the city debt for the substation in about 2 and half or 3 years. **************************************************** Houston Marathon: More than 23,000 runners participated in Sunday’s Chevron Houston Marathon, including a contingency from Liberty County. Topping the field of local contenders was 45-year-ol Robert Dunn of Liberty. Second fastest among locals belonged to Doug Bugner, 54 of Cleveland. Others who completed the marathon from Liberty were 52-year-old Patric Elders, 43-year-old Shannon Smith and 43-year-old John Forames. Two marathoners from Dayton were Miranda Smart age 33 and Art Townsend, 55. A husband and wife from Hardin, Perry and Rachel Cessna, both 26, also finished Sunday’s long distance event. There were also three others from Cleveland. VOLUME 27, NO. 9 FRIDAY, JANUARY 13, 2012 **************************************************** Liberty Council: At their meeting Tuesday night, the Liberty City Council spent some time discussing project options for 2012 certificates of obligation. Among those options is funding for a new police station and new A/C for the Liberty Municipal Library. Liberty City Manager Gary Broz said $1.8 million will cover those costs. Several council members have discussed a higher amount for additional projects including a possible new bell tower to house the Liberty Bell, the possibility of a new tanker truck for the Liberty Fire Department, new sidewalks for the downtown area and a skate park at Liberty’s Municipal Park. The Liberty City Manager said council has not committed to any of these projects. He said a workshop session for council members to discuss these issues is in the works but no date has been set for it. **************************************************** Singing Cadets: Tickets are still available for this Saturday’s performance of the Texas A & M Singing Cadets. The renowned group of young men will be in concert tomorrow night at 7 p.m. at the Liberty ISD Auditorium on Grand Ave. in Liberty. Tickets are $10 for adults and $5 for students. **************************************************** Library Computers: After several months of not working, the Liberty Municipal Library’s 25 public access internet computers are back completely operational. Library Director Dana Abshire said they have been back for a few weeks now. She said they thought the trouble started while installing a new wireless computer system. VOLUME 27, NO. 8 THURSDAY, JANUARY 12, 2012 **************************************************** Murder Trial: Testimony continues today in the murder trial of Gerald Nugent. The 31-year-old along with Martina Sellers is accused of inflicting injuries on their infant daughter Brooke Glyn Nugent that left the child blind and disabled, injuries that allegedly led to her death some two years later. Information is the prosecution is still presenting their case and it is possible Gerald Nugent’s murder trial may continue into next week. The child’s mother, Martina Sellers is also charged with murder in this case, but so far no trial date has been set for her. **************************************************** Liberty City Council: The Liberty City Council met Tuesday night and voted to accept a tax abatement certification from Boomerang Tube LLC for the first year of their abatement agreement. City Manager Gary Broz explained the tubing manufacturer is required to submit this certification each year the city abates their property taxes. As reported, the tax abatement agreement relieves Boomerang of city property taxes for all improvements to their property at 100 % for the first five years. The abatement drops to 75 % in the sixth year, to 50 % in the 7th year and Boomerang Tube begins paying full unabated property taxes to the city after that. **************************************************** New Dayton Chamber Director: The Dayton Chamber of Commerce has named Elizabeth Ellis as new Executive Director of the Dayton Chamber. Sheriff’s Captain Rex Evans said Edwin “Clark” Rogers’ vehicle was found less than two miles from his home. When asked if foul play was suspected, the sheriff’s spokesman said the investigation is continuing. Captain Evans said Clark Rogers is a white male, about 5’6” tall and approximately 200 pounds. VOLUME 27, NO. 6 TUESDAY, JANUARY 10, 2012 **************************************************** Fatality Accident: A 77-year-old former pastor died Sunday evening from injuries sustained in a two vehicle accident on FM 1960 near Dayton. According to a Department of Public Safety report, Rev. Lonnie Gruver of Dayton was traveling westbound on FM 1960 when he moved to the shoulder before attempting to turn left. The report said he did not use a turn signal. The report says a trailing westbound vehicle was passing properly when the Rev. Gruver unsafely turned in front of his car. The driver of that car, Alceuse Jackson of Beaumont was taken to Northeast Memorial Hermann in Humble with a possible broken rib and a concussion. **************************************************** Brotherhood Banquet: One great Liberty County tradition will be renewed for the 86th consecutive year Thursday February 16th. VOLUME 27, NO. 5 MONDAY, JANUARY 9, 2012 **************************************************** Fatality Accident: Two people died in a two-vehicle crash Friday afternoon at the intersection of State Highway 770 and 834 just north of Hull. Both people who died were traveling in a compact car that reportedly failed to yield the right-of-way and pulled in front of a large tree trimming truck. DPS records indicate the driver of the car – Dona Marie Robbins, 58, of Groves and her passenger, Jayden Cook, 16, of Crosby, were probably killed on impact. The driver of the truck was not hurt. **************************************************** Missing Person: Authorities are searching for a missing 62-year-old man – identified as Edwin “Clark” Rogers who lives on S.H. 321 up on the Tarkington Prairie. On Sunday, Liberty County Sheriff’s Department was joined by Texas EquuSearch and Tarkington Volunteer Fire Department in a search near the man’s home. It has been more than four years since the death of 2-year-old Brooke Glyn Nugent. At the time of her death, the child was blind and severely disabled, living in specialized foster care allegedly due to injuries inflicted by her parents back in October 2005. The child’s mother, Martina Sellers, 29, is also charged with murder, but so far, her trial date has not been set. **************************************************** DVFD: Dayton Volunteer Fire Department elected officers at its annual meeting last Thursday. Terry Boyett will continue as chief of Liberty County’s largest volunteer department. He’s held that position for more than 13 years. Assistant Chief is Murphy Green who has served in that capacity for 6 years. In related news, that department has ordered a new fire truck but, for the first time in history, will share the price of that purchase with the City of Dayton. The volunteers and city partnered to buy a new KME Custom-built Class A Pumper with a cab for transporting seven firefighters. VOLUME 27, NO. 4 FRIDAY, JANUARY 6, 2012 **************************************************** Cleveland Rape Case: Thirteen of the 14 adult suspects in the Cleveland gang rape case appeared before 75th District Judge Mark Morefield yesterday. In that proceeding, they were set for another docket call on Feb. 6 as their cases move toward trial. Judge Morefield told one of those 13, Marcus Anthony Porchia, to also be ready for trial on Feb. 27. The 14th suspect, Isaiah Rashad Ross, pled guilty last month to sexual assault of a child and is set for sentencing on Feb. 6. He faces 15 years at sentencing and has agreed to provide truthful testimony against others involved. Those other 13 adult suspects, all from the Cleveland area, are Jared Cruse, Timothy Ellis, Rayford Ellis Jr, Jared McPherson, Kelvin King, Marcus Porchia, Devo Green, Xavier King, Eric McGowen, Carlos Liggons, Jamarcus Napper, Cedric Scott and Walter Harrison. **************************************************** Refuge Dedication: More than 125 people attended a dedication ceremony Wednesday to celebrate the Trinity River Refuge’s new headquarters building on FM 1011. Because of the ongoing court battle over redistricting lines, Liberty County Republican Party Chairman Ken Coleman and local Democrat Party Chair Nancy Archer both report there will soon be a second filing period for those interested in running for elective office in those primary elections now re-set for April 3. The start date for that second filing period has not yet been determined, but the final date and time to sign up will be Wednesday, February 1 at 6 p.m. **************************************************** Dayton City Council: The Dayton City Council held their first meeting of the New Year Tuesday night. Council approved a proposed change for early voting and Election Day locations. Instead of holding voting at city hall as in years past, council authorized City Attorney Randy Gunter to apply to the U.S. Department of Justice to move the elections to the new community center. City Manager David Douglas said the community center would provide plenty of parking, handicapped access and many other advantages. **************************************************** Tax Payments: Interim Tax Collector Ricky Brown said tax payments can be made to his office either all at once or in installments between now and the January 31st deadline without accruing penalty or interest. VOLUME 27, NO. 1 TUESDAY, JANUARY 3, 2012 **************************************************** Rain Fall: While rainfall varies a lot from place to place, KSHN monitors the official records for the U.S. Weather Service here in South Liberty County. For all of 2011, total rainfall for the City of Liberty was 28.38 inches – the lowest yearly total in 55 years. That beats the old record low rainfall mark of 29.64 inches back in 1956. The National Weather Service reports the average yearly rainfall for this area is 61.25 inches. That means this year the City of Liberty is down more than 53 % from a normal year. When entering 2011, Liberty County was already 15.68 inches below normal, with 45.57 inches of rain in 2010. So now we are a staggering 48.55 inches behind the rainfall normal for that 24-month period of time. **************************************************** Fire: A fire damaged a doublewide manufactured home on Industrial Road in Liberty early Monday morning. Liberty Fire Department Chief Fred Collins said it appeared a dog knocked over a space heater in the bathroom in the home. Liberty Fire Fighters were called out at 3:42 a.m. Monday. The occupants of the home at 2112 Industrial Road, Craig Porters and his dog were not hurt. Chief Collins said the bathroom was damaged by the fire and the rest of the home suffered some smoke damage. He said the fire was out and fire fighters were done clearing smoke from the home shortly before 5 a.m. Monday. **************************************************** Tax Office Deadline Hours: The final day to pay Liberty County property taxes without penalty is Tuesday January 31. Interim County Tax Collector Ricky Brown said his office will be open extended hours on Monday January 30th and Tuesday January 31st to give property owners more time to make their tax payments. The tax office in both Liberty and Cleveland those two days will be open from 7:30 a.m. to 5:30 p.m. All of the tax office payment windows are going to be open for those paying property taxes in person. Remember, starting February 1st, 6 % penalty and interest will be added to any unpaid taxes. **************************************************** Cleveland Suspects: The 13 adults accused in the notorious Cleveland gang rape case are scheduled to appear before 75th District Judge Mark Morefield on Thursday.
