Extension Agent Ron Holcomb had provided details of federal requirements for new record keeping for hay producers who sell to others. Since then Mr. Holcomb has learned the information supplied to him may not be accurate. He said a federal report is extremely hard to understand. It is possible the law actually exempt farmers from this record keeping requirements. Attempts to get US officials to clarify their own report has produced little or no response. **************************************************** Popular teacher & broadcaster Nick Vaught had a set back last week when an apple-sized tumor was found on his brain. The 52-yr. old educator had a stroke last school year and has since been hospitalized in Houston. This year it was the dedicated teamwork of Precision Drill. The winning Liberty Co. Rebel Riders placed 27 points ahead of the second place finishers. **************************************************** Monday night, the Dayton City Council approved a new one-year contract extension with Liberty County Emergency Medical Services. City Manager David Douglas said the city is currently operating under the same contract for emergency medical services signed back in 1999 and renewed every year since. The new contract provides for a 10% increase in payments to Liberty County EMS, carrying an overall dollar value of $21,258- minus the $3,804 in rent for the EMS building provided by the city. **************************************************** The Liberty County Office of Emergency Management is continuing the push for all those living in the county who have special needs that would prevent them from evacuating without help during a hurricane to register in advance. County Emergency Management Coordinator Ken DeFoor said, in spite of the media coverage of this effort, only about 11 people have called to provide officials with information on their location and the kind of help they will need. Anyone who will not be able to leave without assistance- for whatever reason- if an evacuation becomes necessary is urged to call 936-336-4558, Ext. 239. **************************************************** Chambers County Judge Jimmy Sylvia said Precinct #4 Constable Bobby Joines tendered his resignation to Chambers County Commissioners last week, after failing to pass the state’s law enforcement certification exam for the third time. Under state law, a newly elected constable has 270 days from the date he took office to pass the test- for Joines, that deadline passed in September of last year. -VOLUME 21 NO. 144 THURSDAY JULY 27TH, 2006-**************************************************** Liberty Police are investigating the aggravated robbery of a Hardin woman at the King Suds Car Wash on Main Street yesterday afternoon. Officer Janie Villatoro said three suspects dragged the unidentified woman from her car and on to the ground. They sprayed the woman in the face with chemical “mace” and she was hit and kicked several times before they left with her purse. The victim said one suspect had a gun. The only description of the suspects available is that they are black males, last seen in a white Ford Taurus. The robbery was around 2:30 p.m. yesterday. **************************************************** DPS Trooper Jamie Nault said 17-year-old Hunter Wilburn of Dayton was making an illegal left turn onto CR # 450 off FM 1409 around 3:30 yesterday afternoon when the pick up truck he was driving was hit nearly head on by one operated by Jerry Davis, 52, of Baytown. Neither Davis nor his passenger Victoria Cooper, also of Baytown were injured but Hunter Wilburn was transported to Memorial Hermann Hospital in Houston with a broken leg. One of two juveniles riding in the truck with Wilburn was also hospitalized, with non-life threatening injuries. **************************************************** The Dayton City Council approved a collection agreement at their Monday meeting with American Municipal Services, a company that specializes in the collection of unpaid fines assessed by municipal courts. City Manager David Douglas said Dayton currently has over $400,000 in delinquent fines and state law allows the company to add a 30% collection fee over and above the amount of the fine. -VOLUME 21 NO. 143 WEDNESDAY JULY 26TH, 2006-**************************************************** The Bureau of Alcohol, Tobacco, and Firearms is investigating a house fire in North Liberty County. It happened Monday night on County Road 2181, off of FM 787 near Dolen. Neighbors reported the fire shortly after 8:30 PM. Tarkington Chief Paul Gregory pulled his fire fighters back when several volunteers were overcome by mysterious fumes while battling the blaze. Chief Gregory added that neighbors believed the residence and out buildings were bobby-trapped, however those reports have not been confirmed. The homeowner, Erika Yvonne Erin Wulf, who was arrested earlier in the day, for outstanding warrants, by Liberty Co. Sheriff’s Deputies, remains in the Liberty County Jail. Sheriffs Department Detective Jeff Ashworth, County Fire Marshall Jim Wilson and Officers of the ATF are still investigating. **************************************************** County Commissioners yesterday in special called session, voted in a 3 % pay increase for commissioners, and an increase in the car allowance of 20 %. The 3 % pay increase is the same as has been given to all county employees. -VOLUME 21 NO. 142 TUESDAY JULY 25TH, 2006-**************************************************** The Dayton Community Development Corporation met in special session last night. After administering the oath of office to newly appointed board member Jackie Cunnill, the board discussed the budget for the upcoming 2006-2007 fiscal year. The proposed budget included returning Executive Director Sue Priddy’s salary to over $70,000 annually. In September of last year, Dayton City Council voted to reduce her salary to $34,000. That action was followed by a lawsuit filed by Mrs. Priddy against the DCDC and the City of Dayton. The DCDC board last night voted, 3-2, to approve the budget, including the salary adjustment. Board members Jackie Cunnill, Bill Fox and Jay Knight voted for, Frosty Pruitt and Troy Barton against. **************************************************** Officer Ricky Pearson with the Liberty Police, said Darlene Lee, 30 of Devers, failed to stop, and struck a pick up truck driven by Lionel David who has slowed for a funeral procession Saturday afternoon. Mrs. Lee’s passenger, Angie Livingston, 21 of Devers, nearing full term pregnancy, reportedly, with twins, struck the dashboard. She was taken to Liberty Dayton Community Hospital with injuries not thought to be serious. The driver of the pick up was also taken to the hospital as a precaution. Experts say limit your pet’s exercise during the hottest part of the day, make sure outdoor pets have a shaded area, and plenty of fresh water, and very important, never leave a pet inside a parked car. -VOLUME 21 NO. 141 FRIDAY JULY 21ST, 2006- **************************************************** A Tarkington woman, Amber Kay Cranney, 25, was seriously injured after she drove off the road to avoid a collision on Hwy. 321 Wednesday night. DPS Corporal Gary Wright said a car in front of Ms. Cranney slowed to turn in front of her, and when the young woman tried to take evasive action she lost control of her SUV, sliding off the road, and hitting a tree. It took rescue workers some 20 minutes to free the woman. She was taken to Memorial Hermann Hospital in Houston with what was described as serious head injuries. **************************************************** With the current heat wave expected to continue for at least a few more days, experts urge extra care in protecting children from the heat. Children are naturally active, and even during normal warm temperatures they can lose as much as a quart of sweat during just a couple hours of activity. Also, since their bodies are smaller, kids absorb more heat then adults and cannot dissipate the heat through sweat as quickly. Experts recommend children always drink water before, during and after any outdoor activity – even light activity like walking. Early signs of heat illness are extreme thirst, headaches and fatigue. **************************************************** Liberty County Court at Law Judge, Don Taylor suffered an irregular heart beat Tuesday afternoon, right after his court session adjourned and is now hospitalized. We learned he was going over court actions of the day with staff when he began to feel dizzy and weak. -VOLUME 21 NO. 140 THURSDAY JULY 20TH, 2006- **************************************************** Daisetta Police Sgt. Russell Pierce said Officer Jimmy Dubuque was on routine patrol around 3 a.m. Wednesday when he noticed someone in the shadows outside the temporary Daisetta City Hall. Upon investigating, the Daisetta Policeman was attacked by person or persons unknown at this time. Officer Dubuque suffered a badly bruised jaw and lost vision in his left eye for about 30 minutes following the assault. He is expected to be off work several days, but suffered no lasting harm. **************************************************** Dayton School Trustees appointed Angie Vinson as Special Education Director for the school district at their meeting Tuesday night. Mrs. Vinson comes to the key administrative position with some 20 years teaching experience, working the past 4 years with the Region 4 Education Service Center. -VOLUME 21 NO. 139 WEDNESDAY JULY 19TH, 2006- **************************************************** A two-vehicle wreck Monday morning on Highway 105 sent 7 Liberty residents to hospitals, two by air ambulance. DPS reports indicate Margarita Barboza, 32 of Liberty was west bound on 105 when she struck a pick up truck and stock trailer that had slowed to make a turn. In her vehicle, Cynthia Barboza, 6, Arial Barboza, 9, Adrian Barboza, age 4, and Jessica Barboza age 12 along with the driver, Margarita Barboza were taken to Cleveland Regional Hospital by Liberty Co. EMS, with minor injuries. Two other passengers, Sonya Gomez, 14 and Carla Shaves, 17, both of Liberty were taken to Memorial Hermann Hospital. Neither the driver nor passenger in the other vehicle were injured. Margarita Barboza was cited for failure to control speed and no driver license. **************************************************** Monday night, the Hardin City Council accepted the resignation of Mayor Alan Tidwell, then turned to a familiar name to take his place. Council unanimously approved former Mayor William E. “Bill” Haynie to serve out the remainder of Tidwell’s term. Haynie served as mayor from 1999-2005. Alan Tidwell resigned as mayor in order to devote his time to the fall election. He is the republican nominee for precinct 3 J.P, and will face Democrat Cody Parrish in November. **************************************************** For those who choose a High Deductible Health Insurance plan, and a Health Savings Account, Insurance agent Bobby Radar suggests keeping all receipts for any medical expenses paid from the Health Savings Account. Charles Isaac told EMS personnel he was cutting on a copper tube when the jolt occurred. -VOLUME 21 NO. 138 TUESDAY JULY 18TH, 2006- **************************************************** Dayton Police Officer Chris Bouford said William Finley of Dayton was unable to stop in time, and hit a pickup driven by Sheila Johns, also of Dayton. Reports indicate, Johns was stopped in the southbound lane of HWY. 321 waiting to turn into Wood Automotive when the accident happened. William Finley and his 7-year-old granddaughter, Alexis were both taken to Cleveland Regional Hospital said to have minor injuries. That wreck happened around 8-yesterday morning. Less than 2 hours earlier, another wreck in Dayton sent Eric Rigsby by Life Flight Air Ambulance to Memorial Hermann Hospital. Officer Bouford said an 18-wheel tractor-trailer was making a legal left turn off of Hwy. 90 on to Hwy. 146 south, when the 16 year old, going east on 90, failed to stop at the red light, striking the big rig. Eric Rigsby was said to have a fractured femur. **************************************************** According to attorney Mike Fielder, the person chosen to administer the estate of the deceased- known as the executor- can only act freely if there is a will. Otherwise, the executor of the estate is put in the position of having to prove to a court that the action he or she is taking is correct. -VOLUME 21 NO. 135 THURSDAY JULY 13TH, 2006- **************************************************** Dayton ISD Chief Superintendent Greg Hayman said the budget they are proposing for the 2006-2007 school year includes not only the state-mandated raise for teachers, but an additional 2.6% as well. Dayton ISD Staff classified as administrative or professional would receive an overall increase of 3.6 %. Clerical and paraprofessionals over all, would get an 8.9 % pay raise, and in manual trades, Dayton employees overall increase is set to be 4.7 % on average. Dayton ISD Chief Financial Officer Tami Pierce said the proposed tax rate for next school year is 1.54 per $100 of assessed value. **************************************************** Liberty City Council met Tuesday night and agreed to establish two new advisory committees to assist council with decisions in a couple of very specific areas. The fund balance at the end of the previous fiscal year was $3.8 million, however this is an odd year since trustees several months ago voted to change the end of their fiscal year from June 30th, to August 31st. -VOLUME 21 NO. 134 WEDNESDAY JULY 12TH, 2006- **************************************************** Tuesday morning Liberty County Commissioners received a check from the U.S. Fish and Wildlife service, specifically the Trinity River National Wildlife Refuge. The check, in the amount of $45,978 is provided annually through the refuge revenue sharing act of 1978. Refuge Manager Stewart Marcus said the funding for these payments comes from the sale of products or privileges on fish and wildlife lands, and from funds appropriated by Congress. **************************************************** Monday night, the Dayton City Council formally approved the increased garbage rates for city customers. City Manager David Douglas drafted the ordinance outlining the new rate adjustments, brought about by a cost of service increase by Waste Management. Residential rates will go from $11.50 to $12.88 and commercial rates from $19.60 to $23.13 per month. The new rates go into effect immediately. **************************************************** A new 50-foot by 50 foot metal building to house the Daisetta City Hall is being constructed across FM 770 from the old city hall. The 2,500 square foot building will house the city offices, courtroom, Council Chambers and the police department. Mayor Lynn Wells said a $48,000 Hurricane Rita damage claim started the project and an additional $80,000- from the city’s budget- will complete it. Representative John Otto said while there is no shortage of water in Southeast Texas, at some point it could make financial sense for other areas of the state to buy land here, pump out the ground water and pipe it, then build surface water treatment plants. The Lower Trinity Ground Water Conservation District would allow for local control and the ability to charge a fee for those capable of producing more then 25,000 gallons a day from a well. Exemptions to that fee would include agricultural use. **************************************************** FLNB President Paul Henry said the new Health Savings Accounts are designed, much like an IRA, to help people pay for out of pocket medical expenses, like co-pay’s and deductibles. Bobby Rader, of Hall Rader Insurance pointed out in order to qualify for the Health Savings Account, a person must have a high deductible health insurance plan. Dayton Police say the young woman apparently hung herself in the bathroom of her home on FM 1960 last Thursday morning. Her boyfriend, Jerome Harris told investigators he found Ms. Harrison hanging around 9 a.m. She was airlifted to Memorial Hermann Hospital in Houston in critical condition and died later that same day. Dayton Police Chief Pete Douzat said an autopsy was ordered. Services are pending at Wells Funeral Home. . **************************************************** In addition to a 7.34% pay raise for Liberty ISD teachers the proposed budget for the upcoming school also includes raises for most other district employees. District Director of Financial Services Margaret Lee said Liberty School Trustees have already approved the teacher pay increases as well as raises ranging from 5.89% to 6.55% for administrators and support staff depending on the job they hold and other factors. The raises will cost the district $647,925 in the new budget. Sgt. Doug O’Quinn said LaTanya Harrison, 29 was taken to Memorial Hermann Hospital in critical condition, said to have severe neck injuries. Police report the woman’s boyfriend, Jerome Harris told investigators he found his girlfriend hanging in the bathroom. Police reports indicate she was not hanging when police and EMS arrived. **************************************************** Liberty ISD Business Services Director Margaret Lee said she will present to the board of trustees a budget that will call for a tax rate for the 2006-2007 school year at 1.5250 per $100 of assessed value. She said already approved for next years budget is a pay increase of 7.34 % for teachers in the district. Another note, since the 2003-04 school year, the district has decreased their tax rate by 28.7%. **************************************************** Representative John Otto said the creation of the Lower Trinity Ground Water Conservation District, would be up to the voters in three southeast Texas counties, Liberty, Polk and San Jacinto. He said the district is only created in those counties where it passes a vote of the public. Representative Otto said the district would give local control to the use and sale of the ground water in those counties. Currently, rights to the water under the ground goes to who owns the property above, meaning someone could start selling off the water with out local input of any kind. The district would have the right to charge a fee of up to .05 cents per 1,000 gallons of water pumped. -VOLUME 21 NO. 129 THURSDAY JULY 6TH, 2006-**************************************************** In September of last year, James Arthur Vestal of Hull was shot to death at the home of Gerald Wells in Moss Hill. At the time Wells told investigators with the Liberty Co. Sheriffs department, he had shot and killed Vestal as the Hull man was trying to break into the home. However, Investigator Mark Ellington said evidence did not back up Well’s story, and Gerald Wells was arrested. Last week, a grand jury indicted Wells for the murder of James Vestal, as well as felony possession of a controlled substance. No trial date has been set. Gerald Wells is currently free on $55,000 bond. **************************************************** The Liberty Co. Sheriffs Department is investigating the robbery of a home on County Road 603, in which the hard earned savings of a family trying to buy a piece of specialized equipment for their hearing impaired daughter at a cost of about $7000, was stolen. Sheriffs Department Captain Billy Tidwell said the thieves made their way into the home sometime between Thursday night June 29th and Friday June 30th when the family was out of town, and stole only the money jar. The Sheriffs Department reports states approximately $3600 was taken. Fielder said these documents are very expensive, difficult to maintain, and do nothing that a will can’t do. He said a couple of problems created with a living trust include the person’s home is no longer qualified for a homestead exemption on property taxes, as well as anything purchased must be turned over to the trust. -VOLUME 21 NO. 128 WEDNESDAY JULY 5TH, 2006-**************************************************** Liberty City Manager Allen Barnes said the Inn at Liberty, which was found to have some very serious life safety violations, was inspected as a part of an annual inspection done at each hotel / motel establishments within the City of Liberty. He said there are six such businesses in the city, and one has been inspected within the past year. As for smoke detectors at the Inn at Liberty, the city manager pointed out those are not the types you pick up at any store. The ones required at a motel or hotel are industrial types that are wired into the electrical system of the building by a licensed electrical contractor. **************************************************** An outreach counselor from Disaster Counseling Services will start weekly visits with citizens at the Daisetta City Hall. -VOLUME 21 NO. 127 MONDAY JULY 3RD, 2006-**************************************************** A Louisiana oil field pole truck overturned into a Gates Street slough in Devers Sunday. The driver approached a wooden bridge too fast, according to DPS trooper Tommy Chase. Driver Jimmy Earl Van Slyke of Lumberton was cited. The truck and bridge were both damaged extensively. A lawsuit has been filed in connection with the bus wreck on Hwy 90 in Devers last March that claimed the lives of two Beaumont high school soccer players. Marion and Joanne Bonura sued the charter bus company, Sun Travel, and the driver with negligence in the death of their 18-year-old daughter, Alicia. The lawsuit charges the bus itself was defective and the driver was not properly trained. Several members of the Westbrook High School girls soccer team were injured. Alicia Bonura and 16-year-old Ashley Brown died in the accident. **************************************************** Some 50 residents of areas surrounding the Cox Road petrochemical waste dump attended a meeting last Thursday night at Dayton High School to get details of the Texas Commission on Environmental Quality’s plan to turn over clean up of the dump to three companies said responsible for creating the danger.
