A teenager formerly of Devers, 19 year old Dystynee Avery, has been murdered in Minnesota. Now three suspects have been charged for their alleged involvement in the local woman’s death. According to a Moorhead Minnesota Newspaper, Charges were filed Thursday, April 23, in Clay County, Minnesota District Court against Andrea Catherine Payne, age 26, and David Marvin Erno-22, both of Moorhead. Payne and Erno each face a second-degree accomplice to murder charge, which carries a maximum punishment of 20 years in prison. Court documents allege Avery’s roommate, 27-year-old Ethan Martin Broad, is solely responsible for her death but documents detail how Payne and Erno failed to report the girl’s death that happened, on or about, April 4 at the apartment where Broad and Avery lived in Minnesota. Broad faces up to 40 years in prison if convicted of second-degree murder. According to court documents: Ms. Payne, who also lived with Broad and Avery at the time, told police, during an interview, that she came home from work when Broad and Avery were arguing in bedroom. At one point, Ethan Broad came out and said Avery might claim he raped her, but court documents do not allege that happened. Andrea Payne told authorities Ethan Broad went back into the bedroom while Payne sat on a couch in another room. Payne could hear their fight continue and then heard, quote - “several loud thumps or strikes,” end quote. Broad allegedly told the others he hit the teenager over the head with a lead pipe and quote - “cracked her skull open,” – end quote. All of that was according to Andrea Payne. The criminal complaint filed against him, charged that Ethan Broad dragged Avery’s body, secluded in a blue bin, from his first-floor apartment to his garage. There he is accused of using several saws to dismember the 19-year old Devers Texas woman. Then he is said to have put her remains in garbage bags and threw them in the apartment dumpster. The Minnesota newspaper report said Payne, Erno and Broad are still in custody in the Clay County Minnesota jail. 27 year old Ethan Broad is accused of the actual murder on a $1 million bond. Andre Payne and David Erno would need $500,000 each for their freedom. Avery moved to Moorhead from Devers – here in south east Liberty Co., about a year and a half ago and was said to be living with Broad, off and on, during her time in Moorhead Minnesota. Investigators found what they believe to be Dystynee Avery's remains at the Clay County landfill after a two-day search. We were not able learn much about the local girl other than she is said to have lived with her parents in Devers briefly. Again, Dystynee Avery – age 19, formerly of Devers was apparently murdered in Moorhead, Minnesota earlier this month. Her dismembered body was found in a landfill. Two men and a woman are being held in lieu of large bonds in a Minnesota jail.
